1. What is a Bequest?
- A bequest is a testamentary provision that allows you to leave all or part of your estate to a chosen beneficiary, here the Fondation EME.
- Types of bequests:
- Specific bequest: a particular asset (e.g., house, sum of money, object)
- Universal bequest: all or a major part of your estate
- Fractional/percentage bequest: a percentage or category of assets
2. Reserved Share and Available Portion
- If you have children, they are legally entitled to a reserved share. You cannot take this away.
- The available portion of your estate can be freely allocated, including to Fondation EME.
3. Taxation
- Bequests to recognized public-interest foundations like Fondation EME are generally taxed at a rate of 4 %, which is favorable compared to other beneficiaries.
- Additional tax benefits may apply for donations made in addition to a bequest.
4. Approval of Large Bequests
- Bequests or donations over €30,000 must be approved by a ministerial decree from the Luxembourg Ministry of Justice.
- Exception: Payments made by bank transfer from an EU or EEA bank do not require approval.
